Small businesses get temporary reprieve from ‘Big Brother,’ but need more certainty

With just weeks to go before tens of millions of small businesses and other entities faced their rights being trampled and being unwittingly turned into felons, a nationwide injunction against Treasury Department enforcement of an obscure reporting rule required by the Corporate Transparency Act has gone into effect. 

While this injunction offers small business owners a temporary reprieve against the “beneficial ownership information” (BOI) rule, they need more certainty.

Jan. 1, 2025, was the deadline to comply with this rule that treated small business owners like financial criminals. It forced anyone with an entity, even solo-business owners with LLCs, S-corporations or other entities, as well as certain homeowners association boards, to register personal information with the financial crimes division of the Treasury (FinCEN).

This information includes copies of a driver’s license or passport for every person in their business or entity who was an owner or who made “meaningful decisions” about the business. This information also has to be updated every time it changes. In addition to the invasive and unconstitutional mandate, the rule set forth fines of nearly $600 a day and jail time for non-compliance. 

TRUMP CAN RESTORE THE AMERICAN DREAM: BRIDGE THE UNIONS AND SMALL BUSINESSES

Yet, the rule exempted large businesses from having to participate.

The stated reason for this rule is beyond the realm of absurdity – to prevent terrorism, money laundering and cartel activity – as if anyone engaged in terrorism, money laundering or cartel activity would proactively register with FinCEN or any other U.S. government entity. With big businesse – the ones more likely to have the resources to engage in unsavory activity – exempt, this rule has targeted small business owners, potentially turning them into felons. 

While most small business owners who know about this rule didn’t want to comply because of its tyrannical asks, even more didn’t know about it. House Small Business Committee Chair Rep. Roger Williams, R-Texas, who has written several letters against BOI as it currently stands, posted on X (formerly Twitter) that, “only 14.2% of small businesses in Texas have submitted compliance with the BOI rule.” 

Many entities and individuals have been fighting against this rule on behalf of the nation’s 34 million small businesses. I went to Congress to testify against it earlier this year. The National Federation of Independent Business (NFIB), The S Corporation Association, The National Small Business Association (NSBA) and others have been working hard trying to put a stop to it.

Following a federal court ruling this spring on a NSBA-led lawsuit which found this rule unconstitutional but limited the scope only to the plaintiff, a lawsuit brought by the Center for Individual Rights (CIR) in conjunction with the NFIB and other small businesses prevailed in getting a Texas judge to grant a nationwide injunction against enforcement of the BOI rule so that small businesses do not have to comply. 

While this was great news, it does not provide enough certainty. An alert on FinCEN’s BOI website notes, “In light of a recent federal court order, reporting companies are not currently required to file beneficial ownership information with FinCEN and are not subject to liability if they fail to do so while the order remains in force. However, reporting companies may continue to voluntarily submit beneficial ownership information reports.” But FinCEN has appealed the ruling and if the courts were to stay the injunction, that could put the reporting and fines back on the table.

Congress needs to act to give small businesses clarity. In addition to delay bills in the House and the Senate, a repeal bill “Repealing Big Brother Overreach Act” introduced in the House by Rep. Warren Davidson, R-Ohio, and in the Senate by Sen. Tommy Tuberville, R-Ala., should be voted on by Congress.

Also, the Trump administration has an opportunity to come out and say that it won’t enforce any fines either – giving more clarity to small businesses headed into the end of the year – and, even better, that Trump’s Treasury will jettison this effort entirely.

Small businesses are not financial criminals; they are the backbone of the economy. The BOI rule nonsense is a perfect example of why Elon Musk and Vivek Ramaswamy are heading the DOGE (Department of Government Efficiency) effort and it should be a top priority for both Congress and the Trump administration as they work to stop saddling productive Americans with rules, regulations, fines and unconstitutional mandates.

Luigi Mangione’s body language as he was escorted into a Pennsylvania courthouse gives insight into the accused killer’s mindset, according to a body language expert.

Mangione, accused of killing UnitedHealthcare CEO Brian Thompson in Manhattan, was arrested in Altoona, Pennsylvania, on Monday when a McDonald’s customer saw he resembled images of the suspect in the shooting. 

Charged in Pennsylvania with forgery and carrying a firearm without a license, he has not waived his right to an extradition hearing to face murder charges in New York. 

As he was escorted into Blair County Court on Tuesday by a cadre of officers, the jumpsuit-clad 26-year-old was wide-eyed and had his head on a swivel as he shouted at surrounding reporters. Susan Constantine told Fox News Digital that Mangione showed a “rigidity” that indicated he was fearful.

But through that, Mangione showed “a sense of arrogance and pompousness” through “just a slight raise of [his] chin” and the way that he literally looked down his nose at his surroundings. 

“Keep in mind what we’re dealing with – a person who has been wronged in his own mind in some sort of way… We don’t know yet exactly all the reasons why,” she said. “We also know he’s adopted some sort of radical belief system, and he also feels that he is the one that needs to act.”

Likewise, Constantine said Mangione’s chin is pointed up in his mugshot photos – both the ones taken in his orange jumpsuit and the one taken in a blue suicide prevention smock.

“Remember I told you that chin is up – when we see the chin up, we can see the Adam’s apple pop out… the Adam’s apple pops up…his nose pops up in the air,” she said. “All of this is pride and arrogance and pompousness – militant and prideful.”

His expression, she said, is a stark contrast from the smiling photograph of the suspect flirting with a hostel employee in New York before the Dec. 4 assassination.

“This was not the sinister killing [face] – this was him, his charismatic personality, his flirty personality, the one that everybody and his friends and family are all talking about,” Constantine said. “He’s a great guy. They like him. He’s, you know, engaging and he’s, you know, speaks in front of the public and doesn’t have any fear about it. That’s his personality.”

“These types of killers disassociate – it’s called cubing,” Constantine continued. “So when they’re in active pursuit, there is one personality. And then when he’s in relationships, he has another one… he’s able to disassociate from what is the sinister thoughts and ideas and radicalism that’s actually flooding through his mind.

“All of a sudden, that smile turned to a frown [during his perp walk] – the lifted cheeks turn into droopy cheeks. And then he had a more rigid and more tension in his facial expression that was dissimilar to what we have seen in the past. So this was a game over expression.”

The suspect’s confident stance during the shooting, captured on surveillance footage, is another side to the “cube” – and indicates the planning that went into the attack. 

“He had already rehearsed – he was ready for the engagement. This was not something that just happened spontaneously. This is something that he thought out, measured and planned,” Constantine said. “That’s why you see his body language being very much in control. He’s not startled. He knows exactly what he’s going to do. That’s why his countenance is down. His energy level is down because he’s in hyper-focus.”

Constantine told Fox News Digital that Mangione’s body language – both during his perp walk and in a photograph snapped by police in a holding cell the day before – indicated that he did not expect to be apprehended by police.

“There are behavioral signatures and cognitions of people that are being deceptive,” Constantine said. “[People display] rigidity when [they are] caught. What do they do? They sit up straight, they’re very militant… So when you think about his structure, he’s just very robotic.”

DEI official at University Michigan fired after being accused of making antisemitic remarks: report

The University of Michigan fired a DEI official after she was accused of making antisemitic statements earlier this year, The New York Times reported on Thursday.

Rachel Dawson, the director of the university’s Office of Academic Multicultural Initiatives (OAMI), was accused of stating that her school was “controlled by wealthy Jews” and that Jewish students are “wealthy and privileged,” according to a complaint from the Anti-Defamation League (ADL) of Michigan obtained by The Times through a FOIA request.

Additionally, Dawson allegedly stated that “Jewish people have no genetic DNA that would connect them to the land of Israel.”

University of Michigan spokesperson Colleen Mastonry declined to confirm or deny Dawson’s termination from the school, saying that the school “would not comment on personnel matters,” the Times stated.

However, the administrator’s lawyer, Amanda Ghannam, declared that the school fired Dawson this week.

According to the lawyer, the official was initially instructed to undergo training in response to her words, though Ghannam denied that Dawson said anything antisemitic, and said her client’s rights have been violated by the school’s disciplinary actions. 

“The university has clearly, blatantly violated Ms. Dawson’s First Amendment rights, and we will take appropriate legal action,” Ghannam stated on Thursday.

Fox News Digital reached out to Ghannam’s office for comment.

The outlet also noted that emails it obtained revealed that “university leaders had planned on a lesser punishment for Ms. Dawson, but a regent argued that she should be fired.”

The Times obtained a memo from the school’s legal representation replying to the ADL’s complaint. It stated that it was “not possible to determine with certainty whether Ms. Dawson made the exact remarks” as “there is no recording of the conversation and no witness other than the reporting parties and the subject of the investigation.”

However, the memo did go on to admit that the “weight of the available evidence supports A.D.L. Michigan’s report.”

Dawson’s reported firing comes amid concerns of wider antisemitism on the school’s campus that spiked due to pro-Palestinian demonstrators protesting Israel’s response to Hamas’ Oct. 7 massacre.

In the wake of the raucous demonstrations that roiled many elite universities nationwide, University of Michigan President Dr. Santa J. Ono appeared before the House Committee on Education and the Workforce in May to testify on the problem.

At the time, Committee Chairwoman Virginia Foxx, R-N.C., told Fox News Digital, “The Committee has identified patterns of antisemitism on Yale’s and Michigan’s campuses and a general failure by these universities to protect Jewish students that must be addressed.”

The University of Michigan’s OAMI office oversees providing resources for diverse and “underrepresented students” to be able to attend the school. 

Its site states, “By partnering with community colleges throughout Michigan, we assist transfer students as they prepare for their successful transition to U-M. Once here, the office is an inclusive community and hub of resources helping students thrive.”

Reports of the DEI official’s firing also come just a week after news broke that the university ended its requirement for diversity statements for faculty hiring, promotion, and tenure.

The university said that diversity statements “have been criticized for their potential to limit freedom of expression and diversity of thought on campus.”

The University of Michigan did not immediately reply to Fox News Digital’s request for comment.

Olympic athlete amateur world champion joins Jake Paul’s boxing promotion

Roughly a month after defeating Mike Tyson, Jake Paul has added to his boxing promotion roster.

Most Valuable Promotions on Friday announced the signing of two-time Canadian Olympian and amateur world champion Tammara “Tamm” Thibeault.

Thibeault will become the first woman in history to make her pro debut under men’s rules – four three-minute rounds – when she steps in the ring on Friday at Most Valuable Prospects 10, with Paul and Amanda Serrano in attendance.

Caitlin Clark White privilege comment sparks intense, personal argument between Riley Gaines and Jemele Hill

Caitlin Clark’s recent comment about benefiting from White privilege in the WNBA has fueled hostile online debates since it was published in Time magazine on Tuesday. Former NCAA swimmer and OutKick host Riley Gaines got in on the action in her latest online debate with a left-wing figure. 

This time, Gaines took on journalist Jemele Hill, who has been a staunch critic of Clark and those who have given the WNBA phenom credit for elevating the league. 

Hill threw the first punch against Gaines, re-sharing a post on X, where the former swimmer criticized Clark for the comments.

“You holler all the time about supporting and ‘protecting’ women, and yet the moment that Caitlin Clark expresses appreciation and respect for the Black women in the WNBA (many of whom she grew up watching and idolizing), suddenly you’re acting like a disappointed parent,” Hill wrote. 

Gaines quickly clapped back, responding to Hill’s post by mocking the idea of “White privilege” in the WNBA. 

“‘White privilege’ in the WNBA is literally hilarious. Maybe you’re like Sunny Hostin & think CC also has tall privilege, pretty privilege, and straight privilege,” Gaines wrote. “Theres lots of Black players in the WNBA I love [and] respect too, but I don’t admire them because they’re Black. I admire them for their game. That’s the difference.” 

Gaines then doubled-down by re-sharing Hill’s initial post with a screenshot of comments the journalist made in an interview with the Los Angeles Times back in May. In that article, Hill insisted it was “naive” to say Clark’s race as a White person and sexuality as a straight woman did not play into her popularity in the WNBA, where the vast majority of players are Black and many are lesbian. 

In that article, Hill also insisted that Clark’s popularity with those attributes are “problematic.”

“Being a long-standing professional race baiter must be SO exhausting,” Gaines quipped to Hill in response. 

In June, Hill said that the fact that Clark did not make the U.S. Paris Olympic women’s basketball team was a “good thing for her” and that her exclusion “wasn’t a snub.” Hill also criticized the media for pointing out that the WNBA’s playoff ratings dropped after Clark’s Indiana Fever were eliminated in the first round, calling the headlines “irresponsible.” 

When Clark made her latest comments about benefiting from White privilege with Time magazine, Hill made a post on X, seemingly mocking the player’s fans who disagreed.

“If you’re mad at something so obvious, that means you were never a real fan of hers on the WNBA, you just liked her as long as she could be your avatar to hate on Black and queer women,” Hill wrote on Wednesday. 

Then, after picking the fight with Gaines on the topic, Hill went so far as to make it personal. 

After Gaines’ comment about Hill being a professional race-baiter, Hill responded with a message mocking the former swimmer for an incident when she tied with trans athlete Lia Thomas at the 2022 NCAA women’s swimming championships.

“Girl, you need to thank Lia Thomas every day of your life for helping you get famous, otherwise you would have been just a decent college swimmer that no one knew. You wrote the book on grifting — not me,” Hill wrote.

Gaines’ infamous tie to Thomas in 2022 helped ignite a national conversation about biological males competing as trans athletes against women and girls. Gaines quickly became nationally-known for the incident and has devoted her platform to advocating for the protection of female athletes from trans inclusion in competition and in locker rooms. 

Gaines is also leading a lawsuit against the NCAA with other female athletes, accusing the governing body of violating their Title IX rights due to its policies on gender identity. The lawsuit, filed in U.S. District Court in Atlanta, details the shock Gaines and other swimmers felt when they learned they would have to share a locker room with Thomas at the 2022 championships in Atlanta.

Additionally, Gaines did not let Hill’s comment about her past slide on Thursday. 

“How deeply regressive [and] utterly misogynistic for Jemele Hill to tell me to thank a man for the platform I have. Thank him for what? Violating us in the locker room? Stealing a national title from a deserving woman? Indirectly stripping us of our 1A rights? Just say you hate women,” Gaines wrote in her response.

That was the last message that was sent in the exchange at the time of publication. 

It would not be the first time Gaines had the final say in an X debate with a left-leaning opponent. 

In a September spat with Dallas Mavericks owner Mark Cuban, Gaines argued the notion that Vice President Kamala Harris has done a “good job” handling the border crisis. 

Gaines ended up with the last word in that debate, as Cuban did not respond to Gaines’ thread when she brought up that Harris’ proposed border bill included funding for Ukraine and Israel and that more than 320,000 migrant children went missing while crossing the border during Harris’ handling of the border. 

Gaines also got in on a viral roast session of Rep. Alexandria Ocasio-Cortez, D-N.Y. on Nov. 14, after it was discovered the congresswoman removed pronouns from her X bio. Gaines made multiple posts shredding Ocasio-Cortez a week after the congresswoman criticized Green Party vice presidential candidate Butch Ware for standing against trans athletes in women’s sports. 

Gaines took aim at Harris herself after the losing presidential candidate posted a surprise video on social media to her supporters. 

“Now do you understand why she didn’t go on Joe Rogan lol,” Gaines wrote.

Each of Gaines’ spats with the liberal figures has been met with roaring engagement from her followers.

‘Yellowstone’ star Luke Grimes says Kevin Costner’s exit made it the ‘easiest season we’ve filmed’

“Yellowstone” star Luke Grimes is not “pointing any fingers,” but filming the final episodes of season five without Kevin Costner was a breath of fresh air.

During a sit-down with Esquire, Grimes addressed Costner’s notable absence during the final installment of the hit Western.

“Hopefully everyone can see that it was time,” Grimes said, referring to Costner’s exit.

“To be really honest, there was a part of Kevin being gone that meant some of the conflict was gone. Obviously, it didn’t make it super fun to be around. Not pointing any fingers, but it was actually the easiest season we’ve filmed,” he continued.

The series finale of “Yellowstone” airs on Dec. 15. According to Grimes, the show coming to an end after seven years on-air was “good timing.”

“Seven years is a long time to do anything, and I had never played a character for more than a few months before. I’ve loved all of it. But there is a part of it that — once you read those final episodes — sees that there’s a finality to it,” he said.

Grimes, who stars as Kayce Dutton on the show, talked about the possibility of a future spin-off.

“There’s always talks of spin-offs. I’d do it [but] I just don’t understand how it would work once the story ends,” Grimes said. “Kayce wants to cowboy and be happy with his family. 

“He doesn’t want to kill people anymore. He doesn’t want the weight of a huge mega-ranch that isn’t sustainable in today’s times. He wants his little slice of heaven. It’s that simple.”

From the start, the show’s creator, Taylor Sheridan, purposely kept the ending from Grimes.

“From the very beginning, Taylor told me, ‘I know how the show ends, but I don’t want you to know how it ends,'” he said. “‘I think you would just play things differently [if you knew the ending], and I don’t want you to know anything.'” 

“So, I kept that in mind, and I wanted to wait to read it until we filmed the very last episode. But it had been so long since we shot and I felt like I just didn’t remember what we did. I didn’t remember how to play Kayce. I couldn’t lock in.

“I thought, ‘If I just read the last one, I bet it would help.’ So, I read it, and it really got me. I felt totally connected to the story again, and I couldn’t imagine it ending any other way,” Grimes said.

During the interview with Esquire, Grimes explained that at the current moment, he is not the biggest “Yellowstone” fan.

“I want to like the show, and I bet one day I will, but it was kind of hard to because I was still in it,” Grimes said. “I want to give it a couple years, and just to cleanse the palette. Then I’ll go through all of it.”

‘Dexter: Original Sin’ star Christian Slater says he was a ‘frighteningly different person’ in the 90s

Christian Slater reflected on how his life has changed since the height of his fame in the 1990s.

The 55-year-old actor became one of the era’s biggest A-listers after starring in a slew of hit movies. At the same time, Slater was battling drug and alcohol addiction, which led to a series of legal troubles that derailed his acting career.

Slater and his co-star in the new show “Dexter: Original Sin,” Molly Brown, recently sat down for an interview with Fox News Digital during which the actor opened up about becoming a devoted family man after his days as one of Hollywood’s most notorious bad boys.

“I was a frighteningly different person back in the ’90s,” Slater said.

He continued, “I don’t really even recognize who that person was. And today it’s certainly very different.” 

“The hardest thing for me today is leaving home to go do a job,” Slater added. “Back in the 90s, it was like all I could wish for was just to be somewhere else all the time. Now I really like to be home.”

Slater, who launched his career at the age of 7, made his career breakthrough starring as the villainous high school student Jason “J.D.” Dean in the 1988 cult classic “Heathers.”

Over the next decade, he cemented his movie star status with leading roles in hit films like “Robin Hood: Prince of Thieves,” “True Romance,” “Interview with the Vampire” and “Broken Arrow.”

As Slater’s career began to soar, his substance abuse issues resulted in a string of legal woes. In 1989, the actor was arrested for DUI and sentenced to 10 days in jail. Slater was arrested again in 1994 for attempting to board a plane with a handgun at New York City’s John F. Kennedy airport.

In 1997, Slater was sentenced to three months in prison after being convicted of punching his girlfriend and assaulting a police officer while under the influence of heroin and cocaine. After being arrested, the New York native spent three months in a rehabilitation facility. He entered rehab again after completing his prison stint.

The “Hard Rain” actor’s career began to decline as his legal troubles mounted. In 2005, Slater quit drinking and using drugs, and he has maintained his sobriety ever since. Slater mounted a successful career comeback in 2015 when he starred in the hit show “Bad Robot,” earning a Golden Globe Award for his performance.

During an 2015 interview with Details, Slater reflected on how he had come to terms with his past struggles.

“Look, I could spend a lot of time kicking the s— out of myself for the choices I made,” Slater said. “I was dealing with alcoholism and addiction, and there was a lot to take on without much life experience. Addiction is not pretty, and you don’t fully understand it unless you’re dealing with it head-on.”

Slater also told that outlet that his time in prison was “not so bad” and he believed that it was “necessary” at the time.

“Jail was a result of me not taking time for myself,” he said. “So I was forced to take some time for myself. It was necessary for me. When you’re going down that path, you either kill yourself or you’re forced to take time out.”

After overcoming his addiction issues, Slater turned his focus to his family. The actor shares son Jaden, 24, and daughter Eliana, 22, with his ex-wife Ryan Haddon. Slater and his wife, Brittany Lopez, are parents to a 4-year-old daughter, and the couple welcomed a son in July.

While speaking with Fox News Digital, Slater said his life as a father to an infant is “great.” He explained that getting up when his baby son is crying in the middle of the night can be “challenging” at times but “it’s also so gratifying.”

“He’s only five months, but somehow my wife only hears him calling ‘Daddy’ at 5:30 in the morning,” Slater said with a laugh. “I’m like, ‘OK.’ But you get up, you go in there, you see him, and he’s just the best, and he’s just smiling and funny.”

“It’s great,” he added. “I love it.”

Slater is starring in the new Showtime series “Dexter: Original Sin,” which premieres on Friday. “Dexter: Original Sin” is a reboot of Showtime’s hit serial killer series “Dexter,” which starred Michael C. Hall in the titular role and ran for eight seasons from 2006 to 2013.

A plot synopsis for “Dexter: Original Sin” reads, “Set in 1991 Miami, “Dexter: Original Sin” follows Dexter (Patrick Gibson) as he transitions from student to avenging serial killer. When his bloodthirsty urges can’t be ignored any longer, Dexter must learn to channel his inner darkness.”

“With the guidance of his father, Harry (Slater), he adopts a Code designed to help him find and kill people who deserve to be eliminated from society without getting on law enforcement’s radar. This is a particular challenge for young Dexter as he begins a forensics internship at the Miami Metro Police Department.”

The show also stars Hall as the narrator, as well as Patrick Dempsey, Christina Milian, Alex Shimizu, Reno and James Martinez and special guest star Sarah Michelle Gellar.

While speaking with Fox News Digital, Slater and Brown, who plays the younger version of Jennifer Carpenter’s “Dexter” character Debra Morgan, recalled how his son was born while they were filming the show.

“Christian’s son was born during the shoot,” Brown said. “We were very lucky to be able to work with Christian during this time and how much he was able to give us.”

The actress continued, “Well, especially even on the day his son was born, he was working with us in L.A. and in every scene with us.”

“And he obviously had a lot going on that day,” she added with a laugh.

“It was a big day,” Slater recalled. “And I was charged up. I was really excited. And, you know, when stuff like that happens, I think it brought everybody closer together. And like the crew guys are asking me every day, ‘Hey, how is your son?’” 

“It was lovely,” he said. “Yeah, it was great.”

In the show, Slater’s character, Harry Morgan, who was originally played by James Remar, is the adopted father of Dexter and the biological father of Debra. Harry is a detective with the Miami-Dade Police Department and a forensics expert who trains Dexter to focus his homicidal impulses on killing murderers without getting caught.

Though Harry is long deceased before the events of the original series, he appears in flashbacks throughout the first two seasons and later in Dexter’s visions as his voice of reason.

Slater told Fox News Digital that he was excited by the opportunity to play Dexter’s father and show more of Harry’s backstory.

“I love James Remar,” Slater said. “I’m a huge fan of his, and I thought he did a fantastic job in the original show. But this gave us an opportunity to explore the character further.”

He continued, “You only got to see glimpses of him in the original show. And this was a chance to really look at his background and make some new discoveries.”

Prosecutors seeking death penalty for illegal migrants accused of killing 12-year-old Jocelyn Nungaray

Prosecutors in Texas are seeking the death penalty for two illegal migrants from Venezuela who are accused of killing 12-year-old Jocelyn Nungaray in June. 

Franklin Pena, 26, and Johan Martinez-Rangel, 22, were indicted in September on capital murder charges in connection with Nungaray’s murder. Documents say Pena and Rangel kidnapped Nungaray and caused her death by applying pressure to her neck. The two are also accused of sexually assaulting her before leaving her body under a bridge. 

Harris County District Attorney Kim Ogg told Fox and Friends on Friday her office is now seeking the death penalty for the pair.
