Daniel Penny defense weighing malicious prosecution lawsuit after trial: ‘Collusion from the very beginning’

Marine veteran Daniel Penny’s defense team is eyeing a malicious prosecution lawsuit against District Attorney Alvin Bragg and others behind the charges, turning the tables after the lengthy high-profile case concluded with an acquittal.

“Just like Danny said in his interview, it was like they wanted to try and get him on something,” Penny’s defense attorney Steven Raiser said Wednesday, reacting to the acquittal on “Fox & Friends.”

“They knew they weren’t going to be able to get him, so they had to get rid of that top count in order to get to that second count, just in hopes that maybe they could pull out a win here, and they were unsuccessful, thank God.”

Raiser said the suit would target Bragg for “blurring” the “ethical lines” with the case’s handling. The filing would also home in on the medical examiner’s office, which he alleged colluded with Bragg’s office.

“The record was made fairly clear as to the extent of his involvement and what occurred here,” he said. “He was appointed by Mayor Adams, [who belongs to the] same political party as Alvin Bragg. There was collusion there, and the collusion began from the very beginning of this case and all the way through. The district attorney needed the medical examiner and needed the medical examiner to act quickly, and he did just that.”

Penny was charged with second-degree manslaughter and criminally negligent homicide in 30-year-old homeless man Jordan Neely’s death on a New York City subway after he put Neely in a chokehold for threatening other passengers.

The manslaughter charge was dropped at the prosecution’s request on Friday after jurors failed to reach a unanimous agreement twice, setting the stage for deliberations on the lesser, and arguably easier to prove, charge of criminally negligent homicide on Monday.

After a brief return to deliberations, jurors found Penny not guilty.

In a sit-down interview with Fox News’ Jeanine Pirro after the trial concluded, Penny said he didn’t regret his actions and that he “couldn’t live with” himself if he had allowed Neely to hurt someone.

Jana Kramer’s husband will ‘never’ allow his wife to film sex scenes like the ones in ‘Yellowstone’

Jana Kramer and her husband, Allan Russell, were very candid about how comfortable they are with allowing sex scenes to be filmed during their marriage.

On the actress’ “Whine Down” podcast, Russell joined his wife and discussed a recent “Yellowstone” episode the couple watched together. 

During one of the final episodes of the hit Western, Wes Bentley and Dawn Olivieri filmed a heated sex scene, which prompted the conversation between Kramer and Russell.

“There’s not part of me that will ever, ever, ever allow that, ever, for a man to be that close to you like that,” Russell, a Scottish former professional soccer player, said to his wife. “Never.”

Kramer quickly asked, “What if Taylor Sheridan has me audition and I book a role where I have to have that scene?”

“Then I will go Tommy Lee on everyone,” Russell replied. “I will be phoning the producers and threatening the producers, ‘You need to change that scene. Well, this is for the good of your health, you need to change this scene.’”

Kramer pressed her husband further, and attempted to clarify if he would expect her to turn down any role that came her way if a sex scene was required.

“No. I wouldn’t let you do that scene. No. That’s not good for a marriage, that type of role. It’s not. Especially [as] a man who’s not in the acting world, it’s difficult, therefore that’s my opinion based on, I’m not in that world.”

“You can keep smiling and laughing if you want. But let’s flip it. Let’s flip it because we always do that,” Russell said.

Russell tried to give Kramer a different point of view and asked her how she would feel if he filmed an intimate scene. The “One Tree Hill” actress made it clear that she would be OK with it.

“I’ve dated actors before that have had to do sex scenes,” Kramer said. “It’s literally the most uncomfortable thing ever. Like when I’m giving Turtle a hand job on ‘Entourage’ it’s so uncomfortable. I’m literally taking my hand and rubbing his leg. The motion of it – it’s the most uncomfortable – it’s not sexy.”

Kramer went on to list past moments when she’s filmed intimate scenes with co-stars – including with Stephen Colletti in “One Tree Hill” and with Austin Nichols in “Gaslit By My Husband.”

Biden about-face on pardoning son Hunter unpopular with Americans, poll finds

President Biden’s decision to pardon his son Hunter after previously vowing he would not give his son a pass has the approval of only 20% of Americans, according to a new poll released Wednesday.

The Associated Press-NORC Center for Public Affairs Research poll found about half of adults disapprove of the pardon, which came after Hunter was convicted on felony gun and tax charges. 

About 18% of adults neither approved nor disapproved of the decision, while 8% said they didn’t know enough to say one way or the other, according to the poll.

While Democrats were more likely to approve of the pardon than Republicans and Independents, the poll showed just 38% of Democrats approve compared to 27% who said they disapproved of the about-face.

About 80% of Republicans and 51% of Independents disapproved of the pardon, according to the poll. 

Biden issued a sweeping pardon for Hunter on Dec. 1 after he stated on record multiple times that he would not pardon him should a jury convict his son.

MOTHER OF HUNTER BIDEN’S DAUGHTER DEFENDS PARDON, SAYS HE’S ‘TARGETED BECAUSE OF WHO HIS DAD IS’

The first son had been convicted in two separate federal cases earlier this year. He pleaded guilty to federal tax charges in September, and was convicted of three felony gun charges in June after lying on a mandatory gun purchase form by saying he was not illegally using or addicted to drugs. 

The president argued in a statement that Hunter was “singled out only because he is my son” and that there was an effort to “break Hunter” in order to “break me.”

Reporters grilled White House press secretary Karine Jean-Pierre a day after the pardon, asking whether Biden and his surrogates lied to the American people. Jean-Pierre responded, “One thing the president believes is to always be truthful with the American people,” and repeatedly pointed to Biden’s own statement on the matter.

Senators call on Biden to brief upper chamber on efforts to return Austin Tice from Syria

EXCLUSIVE – In a rare bipartisan push Wednesday morning, senators on both sides of the aisle called on President Biden to instruct his administration to brief the upper chamber by Dec. 20 on efforts underway to free Austin Tice from Syria. 

A letter, first obtained by Fox News Digital, was sent to the Oval Office by Sens. Sen. John Cornyn, R-Texas, and Chris Van Hollen, D-Md, calling on Biden to “seize” the rapidly changing situation in Syria and secure Tice’s return.

“Given the recent fall of the Assad regime and the rapidly changing dynamics on the ground in Syria, we think this moment presents a critical opportunity to secure Austin’s release and bring him home to his family,” the letter, signed by 34 senators, read.

COLLAPSE OF SYRIA’S ASSAD REGIME RENEWS US PUSH TO FIND AUSTIN TICE

The letter applauded comments issued by both Biden and his national security advisor Jake Sullivan affirming that Tice’s return was a “top priority” amid the rebel takeover of Damascus, but lawmakers are looking to be briefed on detailed steps being taken to secure his release.

Multiple rewards systems have been initiated by both the FBI, which is offering up to $1 million, and the State Department’s Rewards for Justice program, which is offering up $10 million, for information pertaining to Tice’s whereabouts. 

State Department spokesman Matthew Miller told reporters Monday evening, “There are intensive efforts underway by the United States to find Austin Tice and bring him home to his family.”

HERE IS WHO IS VYING FOR POWER IN SYRIA AFTER THE FALL OF BASHAR AL-ASSAD

Efforts to connect U.S. officials with on the ground sources who may have information on where Tice is have been renewed. 

Sullivan told ABC’s “Good Morning America” on Monday that the U.S. was working with partners in Turkey through back-channel communications with people in Syria who may have information on which prison Tice was kept in, and the State Department confirmed that hostage-affairs envoy Roger Carstens has been engaging in a similar outreach approach in Beirut. 

The fall of the Assad regime on Sunday brought renewed hope for the return of Tice, who is still assessed to be alive despite his 2012 capture in Damascus and unknown condition, as rebel groups in recent days have begun freeing men, women and children held in Syria’s notoriously deplorable prisons.

“For more than 12 years, Austin’s parents have demanded our government bring him home, and given the evolving situation in Syria, we urge you to seize this opportunity to launch an urgent effort to secure Austin’s release,” the letter penned by Cronyn and Van Hollen stressed. “As a beloved son, brother, Eagle Scout, journalist, and veteran, Austin represents the best our nation has to offer and deserves the full and active support of our government to secure his release. 

“Congress is committed and more than willing to work with you to return him to his loving family. We encourage your administration to utilize all available means to further discourage the hostage taking of American citizens,” it added.

Biden shouldn’t issue pardons for Trump foes, Washington Post writer warns

Washington Post associate editor Ruth Marcus warned President Biden in a new column to ditch the idea of preemptively pardoning government officials who have gotten on President-elect Donald Trump’s bad side.

In the wake of the reports that the Biden White House is considering pardoning Trump’s political enemies so that the Department of Justice can’t go after them once he returns to office, Marcus urged the president to pump the brakes in a Washington Post column, saying the move will inspire future presidents to abuse their pardon power.

“[S]uch a step by Biden would set an unfortunate precedent, one likely to be repeated by some future presidents seeking to shield their allies from retribution,” she wrote.

After Biden pardoned his son Hunter Biden from any crime he “has committed or may have committed” from Jan. 1, 2014 to Dec. 1, 2024, reports began swirling that the president was considering preemptively pardoning some of Trump’s prominent political foes.

Politico reported last week that the White House is currently discussing issuing pardons for Dr. Anthony Fauci, Sen.-elect Adam Schiff, D-Calif., and former Rep. Liz Cheney, R-Wyo.

The outlet noted that White House counsel Ed Siskel is arranging discussions about the potential pardons with several other senior Biden aides, including chief of staff Jeff Zients, though Biden himself has not been a part of the conversations yet.

Marcus argued that despite the threat of Trump going after these and other individuals upon his return, it’s not worth the preemptive pardons.

“Desperate times call for desperate measures. But not so desperate as having President Joe Biden issue preemptive pardons to government officials and others at risk of being prosecuted by the incoming Trump administration,” she wrote.

Marcus expressed that Trump targeting his opponents is a “serious prospect” and that he could very well abuse pardon power himself, but she stressed that Biden should not bite. 

“And yet, a broad grant of preemptive pardons, however tempting, would be a mistake,” she advised, explaining that they would be some of the most sweeping pardons in U.S. history and only set the stage for further pardons down the road.

“Such pardons — issued well before any criminal charges have been filed — have few analogs in U.S. history, certainly not on the scale that would be involved in shielding officials from being prosecuted by the Trump administration,” the associate editor added.

Outgoing Treasury Sec. Yellen ‘sorry that we haven’t made more progress,’ believes deficit must be decreased

Outgoing Treasury Sec. Janet Yellen said that she’s “concerned about fiscal sustainability” and thinks the deficit must be decreased.

She made the comments during the Wall Street Journal’s CEO Council Summit after Greg Ip, chief economic commentator for the outlet, noted that President Joe Biden and Yellen are leaving behind a big budget deficit. “Are you sorry you couldn’t make more progress on that?” he asked. Ip also asked Yellen how much risk the issue presents to the economy.

“Well I am concerned about fiscal sustainability. And I am sorry that we haven’t made more progress. I believe that the deficit needs to be brought down, especially now that we’re in an environment of higher interest rates,” Yellen replied.

Ex-world champion cyclist faces prison time after pleading guilty to lesser charge in death of Olympian wife

Rohan Dennis, a two-time world champion cyclist and two-time Olympic medalist, is facing up to seven years in prison after he pleaded guilty for his role in the 2023 death of his wife, fellow Australian Olympian Melissa Hoskins, in court on Tuesday. 

Dennis, who retired from the sport in 2023, negotiated a plea deal with prosecutors in Australia that will not hold the 34-year-old responsible for the death of his wife, who was struck by his vehicle in front of their home in Adelaide on Dec. 30, 2023 and later died from the injuries she sustained.

The original and more serious charges of dangerous driving causing death and aggravated driving without due care were dropped. Dennis instead pleaded guilty to an aggravated charge of creating likelihood of harm. 

“There was no intention of Mr. Dennis to harm his wife and this charge does not charge him with responsibility for her death,” Dennis’ attorney said in court, via The Australian.

According to initial reports, it is believed that the couple were engaged in an argument at the time of the incident, and that during the fight, Dennis allegedly dragged Hoskins as she was holding onto his vehicle. She suffered serious injuries in the crash and later died at Royal Adelaide Hospital.

Dennis will be sentenced at a later date and could face significant jail time.

Biden will veto bill that would give Trump more federal judges to appoint

President Biden and key Democrats are now opposing a once bipartisan bill that would have authorized 63 new permanent district judgeship, now that President-elect Trump would be the one to fill 21 of those slots once he takes office.

The Senate in August passed the “Judicial Understaffing Delays Getting Emergencies Solved Act” or the “JUDGES Act of 2024,” which staggers the 63 new permanent judgeships the president may choose over the next 10 years. Citing how courts are burdened by heavy caseloads, the bill says the president shall appoint 11 of those permanent judgeships in 2025 and 11 more in 2027. The president would tap another 10 judges in 2029, 11 in 2031, 10 in 2033 and 10 more in 2035, the bill says. 

Democrats are decrying how the bill did not come to a vote in the House before the election – when control of the next presidency, and therefore which party would choose those next 21 judges, still hung in the balance. 

The White House released a statement on Tuesday saying Biden would now veto the bill if it comes to his desk. 

“While judicial staffing is important to the rule of law, S. 4199 is unnecessary to the efficient and effective administration of justice,” the White House said. “The bill would create new judgeships in states where Senators have sought to hold open existing judicial vacancies. Those efforts to hold open vacancies suggest that concerns about judicial economy and caseload are not the true motivating force behind passage of this bill now.”

“In addition, neither the House nor the Senate fully explored how the work of senior status judges and magistrate judges affects the need for new judgeships,” the White House continued. “Further, the Senate passed this bill in August, but the House refused to take it up until after the election. Hastily adding judges with just a few weeks left in the 118th Congress would fail to resolve key questions in the legislation, especially regarding how the judges are allocated.” 

During a House Rules Committee hearing on Monday, Rep. Chip Roy, R-N.C., and House Judiciary Committee chair Rep. Jim Jordan, R-Ohio, made the argument that a significant number of districts in states, regardless of their political make-up, have sounded the alarm about staffing shortages worsening the backlogs of cases. But despite the significant need, they argued, the appointment process has become politicized.

“We need the number of judges,” Rep. Jerry Nadler, D-N.Y., the ranking member on the House Judiciary Committee, admitted. “However, President Trump has shown, he bragged that by his three appointments, he overturned Roe v. Wade. He said he was going to do it. He did it. So don’t tell me it’s not political.” 

“Under this legislation, we all promised to give the next three unknown presidents a certain number of judges,” Nadler said. “Because no one can tell the future we were all at an equal disadvantage, but for this deal to work, the bill had to be passed before Election Day.”

The bill text cites how as of March 31, 2023, there were 686,797 pending cases in the district courts across the country, with an average of 491 weighted case filings per judgeship over a 12-month period.

Shortly before the White House released its statement signaling Biden would veto the bill, Senate Majority Leader Mitch McConnell, R-Ky., gave a speech noting how the JUDGES Act passed the Senate by unanimous consent in August.

The bipartisan support, McConnell argued, proved “that the right to a speedy trial still enjoys overwhelming popularity.” 

“I was particularly encouraged by the vocal endorsement of our friend, the Democratic leader, who recognized the measure as, quote, ‘very responsible, bipartisan and prudent bill that would lead to a better functioning judiciary.’ Soon, we expect the House to take up and pass the JUDGES Act with similar overwhelming support,” McConnell said. “And normally, we could rest assured that such popular action would be signed into law without further ado. But maybe not this time.”

“Last week, the White House seemed to suggest, through anonymous comment that President Biden has concerns with the bill. I, for one, would be curious to hear the president’s rationale. It’s hard to imagine a justification for blocking the JUDGES Act that doesn’t smack of naked partisanship,” McConnell, who did lead the GOP effort to block former President Obama’s appointment of Merrick Garland to the Supreme Court, said. “It’s almost inconceivable that a lame duck president would consider vetoing such an obviously prudential step for any reason other than selfish spite.”

“Litigants across America deserve their day in court,” he said. “They deserve to know the federal judiciary has the bandwidth to carefully and thoroughly consider their cases. The president, former chairman of the Senate Judiciary Committee, is well equipped to appreciate this fact, and I hope he acts accordingly.”
